Once a certified IDR entity issues a determination, the process is over. There is no reconsideration mechanism, no appeal to CMS, and no second bite through a different entity. The selected offer becomes the payment amount and the plan owes it within 30 business days.
Because federal IDR is arbitration, a determination is subject to the limited judicial review that applies to arbitration awards generally. Courts do not re-examine whether the entity reached the right number. The grounds are procedural and narrow — awards procured by corruption or fraud, evident partiality or corruption on the part of the arbitrator, specified forms of misconduct, and arbitrators exceeding their powers.
Under the Federal Arbitration Act, notice of a motion to vacate must generally be served within three months after the award is filed or delivered. That is short, and it runs while your billing team is still reconciling the determination. If you think you have grounds, counsel needs to be involved immediately, not after the payment deadline passes.
For nearly every group, the realistic response to a lost determination is not litigation. It is fixing what produced it: eligibility screening that catches problems before fees are spent, offers built on the permitted factors rather than billed charges, and documentation that gives the entity a reason to prefer your number. Determinations reaching a decision go the provider's way roughly 88% of the time, and the losses concentrate in thin submissions rather than bad luck.
If the plan simply does not pay a determination it lost, that is a different matter — an enforcement and collection question rather than an appeal. It may involve the Departments' complaint process, and it may involve counsel. Do not conflate the two.
