IDR filing for New Jersey providers: which claims go federal, which go state

New Jersey's Out-of-Network Consumer Protection Act covers state-regulated plans and lets self-funded plans opt in — which makes eligibility screening in New Jersey more work than almost anywhere else.

Federal IDR or the New Jersey state process?

New Jersey is bifurcated with a twist. The Out-of-Network Consumer Protection, Transparency, Cost Containment and Accountability Act (2018) governs inadvertent, emergency, and urgent out-of-network care under New Jersey-regulated plans. Uniquely, self-funded ERISA plans may voluntarily opt in to the New Jersey process. Self-funded plans that have not opted in go to federal IDR.

The rule of thumb in every bifurcated state: the state law governs plans the state regulates (fully insured employer plans, individual/marketplace plans, and usually HMOs). Self-funded employer plans under ERISA — the majority of commercial coverage — go through federal IDR unless the plan has affirmatively opted into the state process where that's allowed. Getting this wrong is the #1 reason disputes are thrown out as ineligible.

What the numbers look like

  • New Jersey was among the top seven states for federal disputes in 2024.
  • In the New Jersey state arbitration process, providers win roughly 66% of decisions — lower than the ~85% federal rate, which is why correctly identifying federal-eligible claims matters.
  • Opt-in status must be verified per plan; IDR entities check it during eligibility review.
